"V Global Gathering" Promotion
HOW TO ENTER
To enter, individuals must send an SMS to 0428 863 366 containing their DJ name and postcode. Each entry must not exceed 160 characters in total, including all required information and a space between each item.
SMS entry cost will vary dependent on the mobile network used but will not exceed 55c.
TERMS AND CONDITIONS
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to VIC, WA and QLD residents aged 18 years or over. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.
3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process (including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS costs). Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
4. Incomplete or indecipherable entries will be deemed invalid.
5. Multiple entries permitted, subject to the following: (a) each entry must be substantially unique; and (b) each entry must be submitted separately and in accordance with entry requirements.
6. SMS entry cost will vary dependent on the mobile network used but will not exceed 55c. SMS winners will be contacted by SMS and/or phone and the Promoter will record their address details so that the prize may be awarded. SMS entries via the internet are ineligible. Entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the entrant.
7. Promotion commences on 26.10.08. Entries close 10pm AEDST on 18.11.08. The judging will take place on 19.11.08. Winners will be notified by telephone and mail.
8. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on creative merit of the answer provided to the question.
9. The Promoter's decision is final and no correspondence will be entered into.
10. Entries will be divided into the following State groups: VIC, QLD and WA. The best 15 valid entries in each State group will each win the prize of a VIP double pass to the Global Gathering event in their State (exact locations to be determined by the Promoter in its absolute discretion) valued at $370. Prize includes a double pass to the event and $100 in the form of a cheque to put towards transport to and from the event on the day. Any other ancillary costs are not included and are the responsibility of the winner and their companions. Prize must be taken to coincide with the event in their State. Events will be held on 22.11.08 in Melbourne, 23.11.08 in Perth and 29.11.08 in Brisbane.
11. If for any reason a winner does not take the prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.
12. If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification.
13. The Global Gathering ticket prizes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organizers hereby expressly reserve the right to eject any winner (and/or his/her companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
14. Total prize pool value is $16,650.
15. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
16. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
17. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if any of the Global Gathering events are cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) attendance at a/the prize event.
18. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
